應尊重終審庭的判決

自 終 審 庭 判 決 僱 員 在 放 假 期 間 不 一 定 可 獲 僱 主 發 放 佣 金 後 , 勞 工 界 非 常 不 滿 , 認 為 與 現 有 的 勞 工 法 例 的 原 意 不 一 致 , 大 力 要 求 政 府 重 新 立 法 , 以 防 止 法 院 往 後 又 按 終 審 庭 的 案 例 來 判 案 。 
勞 工 界 這 種 做 法 , 使 人 想 起 人 大 為 居 留 權 問 題 的 釋 法 事 件 。 其 不 妥 之 處 就 是 在 終 審 庭 有 判 決 之 後 才 試 圖 作 相 反 方 向 的 修 正 , 變 成 輸 打 贏 要 , 一 點 也 不 尊 重 法 治 精 神 。 
「 人 大 」 尚 可 以 說 , 香 港 的 洋 法 官 不 理 解 《 基 本 法 》 的 立 法 原 意 , 因 為 當 年 《 基 本 法 》 的 原 意 確 是 來 自 北 京 , 並 且 明 文 規 定 解 釋 權 在 「 人 大 」 。 但 香 港 本 身 的 法 例 沒 有 立 法 原 意 的 概 念 , 有 關 立 法 的 意 圖 應 可 在 法 例 的 條 文 中 顯 示 出 來 , 至 於 這 些 條 文 應 如 何 理 解 , 如 何 運 用 , 該 由 法 庭 去 作 判 決 。 這 樣 , 司 法 獨 立 才 有 保 障 。 
終 審 庭 的 權 威 是 社 會 公 認 的 , 怎 可 以 懷 疑 終 審 庭 的 五 位 大 法 官 對 現 有 的 勞 工 法 例 的 立 法 意 圖 都 不 理 解 ﹖ 從 今 次 終 審 庭 的 判 詞 中 , 已 可 看 到 , 終 審 庭 在 裁 決 時 , 已 充 分 參 照 現 有 的 勞 工 法 例 , 並 一 併 考 慮 了 事 件 發 生 時 的 社 會 實 況 。 在 一 個 法 治 的 社 會 裡 , 有 時 法 官 在 判 案 時 , 會 發 現 某 些 法 例 已 不 適 合 新 的 社 會 環 境 , 因 而 建 議 立 法 機 關 予 以 修 訂 。 而 立 法 機 關 在 修 訂 法 例 時 , 亦 一 定 會 參 照 有 關 法 官 的 建 議 , 沿 著 同 一 個 方 向 去 修 訂 。 不 可 能 法 庭 剛 作 出 裁 決 , 行 政 立 法 機 關 就 不 以 為 然 , 要 重 新 立 法 , 作 相 反 方 向 的 修 訂 。 
勞 工 界 認 為 這 樣 做 很 有 必 要 , 因 為 這 才 可 堵 塞 法 庭 再 犯 同 樣 錯 誤 的 機 會 (終 審 庭 有 裁 決 後 , 其 他 下 級 法 庭 必 須 跟 隨 , 除 非 有 新 的 立 法 )。 然 而 , 這 樣 一 來 , 終 審 庭 的 威 信 何 在 ﹖ 如 果 重 新 立 法 後 , 又 有 同 類 案 件 要 交 終 審 庭 裁 決 , 而 終 審 庭 的 法 官 又 再 對 立 法 意 圖 有 不 同 理 解 , 我 們 是 否 又 再 重 新 立 法 , 把 條 文 寫 得 更 明 確 一 些 , 還 是 乾 脆 把 終 審 庭 的 法 官 也 辭 退 , 換 過 一 批 聽 話 的 法 官 算 了 。 大 家 試 想 一 下 , 我 們 是 否 希 望 香 港 變 成 一 個 這 樣 的 社 會 ﹖ 
比 較 合 理 的 做 法 是 按 終 審 庭 的 裁 決 來 修 訂 現 有 法 例 , 令 兩 者 更 為 一 致 , 以 減 少 未 來 的 矛 盾 , 而 不 是 只 遷 就 勞 方 的 要 求 , 企 圖 透 過 修 例 去 迫 終 審 庭 的 法 官 就 範 。 
當 然 , 終 審 庭 的 裁 決 並 不 等 同 神 的 旨 意 , 法 官 也 是 人 , 一 樣 會 犯 錯 , 萬 一 真 的 出 現 終 審 庭 的 裁 決 真 的 與 大 多 數 人 民 意 願 相 違 背 時 , 我 是 贊 成 由 人 民 另 立 新 的 法 例 , 以 防 止 同 樣 的 錯 誤 延 續 下 去 。 
但 立 法 並 非 解 決 一 切 問 題 的 良 好 方 法 , 僱 傭 關 係 必 須 建 立 在 你 情 我 願 的 基 礎 上 , 以 立 法 方 式 把 勞 方 的 意 願 強 加 在 資 方 身 上 , 並 不 一 定 有 好 結 果 。 不 過 這 個 問 題 複 雜 , 只 好 留 待 明 天 再 續 。
